Collective Enfranchisement, otherwise known as freehold purchase is carried out by making use of the provisions of the Leasehold Reform, Housing and Urban Development Act 1993 The provisions of this act allow lessees to collectively purchase the freehold from the freeholder under certain conditions.We would normally advise that if there are any management-related problems, a “Right to Manage” process is a more cost-effective way of taking control of management and it takes the shortest possible time. For individual flats seeking to extend their lease, we would recommend a lease extension process.
There are, however, scenarios where clients wish to purchase the entire freehold between them and whilst it is generally more expensive per individual than lease extension, it can offer certain benefits.
Freehold purchase offers lessees the chance to extend their leases to 999 years. It can offer them the control necessary to prevent the freeholder from further developing a freehold.
